These Terms of Use (“Terms”) are a binding agreement between you and doodDevelopments, LLC (“SwellPirate,” “Company,” “we,” “us,” or “our”) governing your use of swellpirate.com and the SwellPirate iOS application (together, the “Services”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services. You must be at least 18 years old to use the Services.
Our Privacy Policy explains how we handle personal information and is incorporated by reference.
SwellPirate helps you discover surf destinations, browse conditions and travel context, set Sirens, and (where available) access Pro features. Content is provided for informational and planning purposes only. We may change, suspend, or discontinue any part of the Services at any time.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use.
You agree not to:
The iOS app uses your Apple ID / iCloud (CloudKit) to store Sirens, Flags, and related data. You are responsible for your Apple account and for activity under it. We do not provide a separate SwellPirate password.
Paid features (such as SwellPirate Pro) are offered as in-app purchases through the Apple App Store. Apple is the merchant of record. Payment, billing, renewals, refunds, and cancellation are handled by Apple under Apple’s terms.
Prices and offerings may change. We do not guarantee continuous availability of any paid feature.
You are responsible for content you create in the Services (such as Siren settings or feature requests). You retain ownership of your content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, and process that content solely as needed to operate and improve the Services.
Surf forecasting is inherently uncertain. SwellPirate does not guarantee surf, conditions, or that any forecast is complete or correct. Always do your own research before traveling or entering the water.
If you book flights, lodging, surf camps, or other services through third-party links (including Kiwi, Airbnb, Booking.com, and similar), those bookings are between you and the third party. SwellPirate is not a party to those contracts and is not liable for cancellations, refunds, changes, or issues with third-party providers.
Some links on the Services are affiliate links, including links to Booking.com. If you click and complete a qualifying booking, we may earn a commission at no extra cost to you. This does not change the price you pay or our obligation to disclose material connections where required by law.
The Services, including branding, design, and content we provide (excluding your user content and third-party materials), are owned by doodDevelopments, LLC or its licensors. These Terms do not transfer any ownership rights to you.
The Services may integrate or link to third parties (Apple, RevenueCat, WishKit, PostHog, Plausible, Resend, Booking.com, Open-Meteo, and others). Your use of those services may be subject to their terms and privacy policies.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOODDEVELOPMENTS, LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US $50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.
You agree to indemnify and hold harmless doodDevelopments, LLC and its officers, employees, and agents from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Services or your violation of these Terms.
You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Services. Provisions that by their nature should survive (including ownership, disclaimers, liability limits, and governing law) will survive termination.
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Courts located in Wyoming will have exclusive jurisdiction over disputes arising from these Terms, except where prohibited by law or where Apple’s App Store terms require a different venue for purchase-related disputes.
We may update these Terms by posting a new version on this page and updating the effective date. Continued use after changes constitutes acceptance. If you do not agree, stop using the Services.
